About Roland
Hello,welcome to my websiteIt is an honor and a privilege to serve as a member of the Ohio House of Representatives. I am proud to serve the people of the State of Ohio and the people of the 40th House District.I hope you will learn more about my background, experiences, interests, and involvements. More importantly, I want you to be informed about legislative issues and how legislative decisions may impact you in your everyday life. Our societal and economic challenges are many, but I believe we will weather the storm. Although it is incredibly challenging to work with our Governor and members of the Republican majority in both the Senate and the House of Representative, I do look forward to working with my colleagues in the House of Representatives and other state elected officials from both parties on making Ohio better, safer, and economically stronger. By working together, I believe we can make the 40th District and Ohio a better place to live, work, and raise a family. During each General Assembly, I keep a somewhat hectic schedule involving briefings from those representing many interests desiring new legislation or requesting legislative modification. In Columbus, I meet with our Democratic Members of the House of Representatives and members of the Legislative Black Caucus, heads and ambassadors of foreign states, serve on panels, and co-sponsored significant measures. Our session days are typically on Tuesday, Wednesday, and Thursday of each legislative week. In the “District,” I meet with area elected officials, community and business leaders, constituents, make personal appearances, and present proclamations for various commemorative events. My committee assignments for my second term (129th General Assembly), are the Criminal Justice Committee as Ranking Member, and as a member of the Ways and Means, Small Business and Economic Development Committees. I have also been appointed by the Speaker of the House and the Minority Leader to serve on the Minority Health and the Criminal Justice Sentencing Commissions. As a state legislator, I enjoy the privilege of governing to protect the interests and values of our local communities, especially working families and seniors whose lives are significantly affected by state government. Similarly, I strive to advocate for business development, expansion, and retention, especially for minority entrepreneurs.Through your words of encouragement, by your vote or financial support, or both, you have entrusted in me your continuing interest in my evolving role as a State Legislator, I am remain humble by your desire to see me succeed as a State Representative. Biography
State Representative Roland Winburn (D-HarrisonTwp.) is serving his second term as the voice of Ohio’s 40th House District. He represents Trotwood, Harrison Township, parts of Huber Heights, Riverside and Dayton.
Representative Winburn is a Midwest Council of State Governments, 2010 graduate of the prestigious Bowhay Institute for Legislative Leadership Development as a BILLD Fellow. Winburn is a Dayton native Graduate of Chaminade High School. Graduate of Central State University (BA in Psychology) Education and Work HistoryPsychotherapist: Good Samaritan Hospital and Health CenterChild and Family Psychotherapist : Private psychological practice.Fund Development Director: The National Conference for Community and Justice of Greater Dayton Public service Montgomery County’s Office of Family and Children First Appointed as a Harrison Township Trustee in 2001 Elected: four-year terms in 2002 and 2006. Representative Winburn successfully owned/founded Ajenti Limousine & Management Service in Dayton. Representative Winburn and his wife of 42 years, Iris, are members of Saint Benedict the Moor Catholic Church. They enjoy spending time with their adult children and their families, which include four grandchildren.

It will become the responsibility of State Legislatures to see that the necessary infrastructure exists to meet the needs of the 21st Century economy in Ohio.” Health• Advocate for biomedical research to make Ohio a world leader • Encourage involvement in wellness and prevention programs • Make certain that prescription drugs are affordable • Ensure care for children who are at-risk and sick kids receive early detection services. • Limit awards for non-economic damages in medical malpractice cases and seek alternatives to jury trials • Ensure medical coverage to those who cannot afford it by delivering services more efficiently. Jobs• Reduce barriers to job growth by creating policies that will attract new businesses/industries• Focus on workforce development and job trainingQuality of Life• Create and maintain great places for workers to live and for our kids to learn and play by investing in the arts, in cultural activities, recreational and natural resources, historic preservation, and tourism.Seniors• Protect senior citizens from exploitation and abuseEducation• Make sure kids receive a world-class education by having access and opportunities to the tools they need to succeed.• Demand results from all schools by teaching toward achieving excellence.• Maintain a safe learning environment. Higher Education• Keep public college and university tuition low for Ohio's students• Make sure that Ohio's universities are meeting the needs of tomorrow's employers and leaders by investing in community colleges, vocational, and technical education by encouraging and investing in life-long education and vocational and technical training. Veterans• Assure that veterans who fought for our freedoms have access to programs and services,e.g. to health care coverage, housing; training and employment services; drug and alcohol counseling; mental health services, including relationship problems. Energy/Infrastructure• Advocate for funding for aging and deteriorating roads, bridges, drinking water systems and wastewater systems and to development brownfields sites. • Promote Ohio as the right place for renewable energy technology investment• Encourage students to develop math, science and engineering skills to use Ohio’s natural resources to power a new, vibrant Ohio economy

SENATE BILL 5,/ ISSUE 2: SUMMARYThe Public Employee Collective Bargaining LawState employees and employees of state institutions of higher education• Abolishes the collective bargaining rights of employees of the state, of any agency, authority, commission, or board of the state, and of any state institution of higher education.• Prohibits the state, agencies, authorities, commissions, and boards of the state, and a state institution of higher education from collectively bargaining with its employees.• Abolishes the Office of Collective Bargaining.Police and fire department supervisors• Removes a limitation on the definition of "supervisor" with respect to members of police and fire departments, potentially making more people supervisors and ineligible to collectively bargain.Contract employees and employees of regional councils of government• Excludes persons working pursuant to a contract between a public employer and private employer and over whom the National Labor Relations Board has declined jurisdiction from those persons eligible for collective bargaining.• Excludes employees of a regional council of government from those persons eligible for collective bargaining.Rights of public employees• Removes continuation, modification, or deletion of an existing collective bargaining agreement from the subject of collective bargaining.• Removes a provision granting specific authority to public school employees to collectively bargain for health care benefits. • Authorizes public employees to refuse any representation by an exclusive representative or an employee organization.Open shops• Makes any agreement that purports to require that employees join any exclusive representation void and unenforceable.Subjects for collective bargaining• Makes the following inappropriate subjects for collective bargaining: (1) employer-paid contributions to any of the five public employee retirement systems and (2) health care benefits for which the employer is required to pay more than 80% of the cost.• Permits public employers to not bargain on any subject reserved to the management and direction of the governmental unit, even if the subject affects wages, hours, and terms and conditions of employment.Collective bargaining agreement provisions and approval• Prohibits a collective bargaining agreement from prohibiting a public employer that is in a state of fiscal emergency from serving a written notice to terminate, modify, or negotiate the agreement.• Prohibits a public employer from agreeing to a provision in a collective bargaining agreement that requires the public employer, when a reduction in force is necessary, to use employee length of service as the only factor when making layoffs.• Prohibits a public employer from agreeing to a provision in a collective bargaining agreement that requires the employer to pay more than 80% of the cost paid for benefits.Conflicting provisions of agreements• Makes laws pertaining to the provision of health care benefits to public employees prevail over conflicting collective bargaining agreements.School districts, educational service centers, community schools, and STEM schools• Prohibits a public employer that is a school district, educational service center, community school, or STEM school from entering into a collective bargaining agreement that does specified things, such as establishing a maximum number of students who may be assigned to a classroom or teacher.• Requires collective bargaining agreements between such an education-related public employer and public employees to comply with all applicable state or local laws or ordinances regarding wages, hours, and terms and conditions of employment, unless the conflicting provision establishes benefits that are less than provided in the law or ordinance.• Requires the parties to consider, during negotiations, the financial status of the public employer at the time period surrounding the negotiations for purposes of determining the ability of the employer to pay for any agreed terms.• Prohibits the parties from basing the ability of the employer to pay for terms of the agreement on potential future increases in the employer's income that would only be possible by the employer obtaining funding from an outside source, including the passage of a levy or a bond issue.Dispute resolution procedures, strikes, and unfair labor practices• Revises collective bargaining dispute resolution procedures.• Requires the employer and the State Employment Relations Board to post in a conspicuous location on the web site maintained by the board and the employer the terms of the last collective bargaining agreements offered by the employer and the exclusive representative at specific times.• Revises the factors that a person or group administering an alternate dispute resolution procedure must take into account.• If either party rejects a fact finding panel's recommendations, permits the public employer to implement, in whole or in part, any of those recommendations that have been approved by the appropriate legislative authority.• Removes the mandatory final offer settlement conciliation procedure for public employees who do not have the right to strike.• Requires a public employer to report certain information about compensation paid to public employees under a collective bargaining agreement. • Specifies that expressions of views, opinions, and arguments are not unfair labor practices, and cannot be used as evidence of such, without a threat.• Repeals the provision requiring the Public Employee Collective Bargaining Law to be liberally construed.• Allows public employers to set aside any provision in an existing collective bargaining agreement in the event of a fiscal emergency.Public employee pay• Requires merit-based pay for most public employees, including teachers and nonteaching school employees and board and commission members, and makes other, related changes.• Generally eliminates statutory salary schedules and steps.Public employee benefits• Abolishes the School Employees Health Care Board, the School Employees Health Care Fund, and the Public Schools Health Care Advisory Committee, and allows the board of education of any school district to govern employee health care benefits in the same way as the governing board of any public institution of higher education.• Limits public employer contributions toward health insurance premiums to 80%.• Requires boards of education to adopt policies to provide leave with pay for school employees and abolishes statutorily provided leave for those employees.• Abolishes continuing contracts for teachers, except for those continuing contracts in existence prior to the effective date of the bill.• Prohibits a public employer from paying employee contributions to certain retirement systems.Reduction in the public sector work force• Removes consideration of seniority and of length of service, by itself, from decisions regarding a reduction in work force of certain public employees.• Makes changes to retention point provisions, including Constituent Services

The 40th Legislative House District of Ohio includes the city of Trotwood and Harrison Township, and portions of the cities of Dayton, Huber Heights, and Riverside in Montgomery County.

Of those cities in the 40th Legislative House District, the city of Dayton is the largest urban city and is the county seat of Montgomery County. It is located at the Crossroads of America where the I-75 north/south meets the I-70 east-west, making it the perfect destination for business or pleasure, a family getaway or a spur-of-the-moment day-trip.

The 40th Legislative House District is abundant in natural resources, benefits from vibrant arts, its many cultural events, and from a wealth of regional activities.

Industry

Major Industries Greater Dayton Area includes manufacturing, defense, healthcare, services, transportation, utilities, and wholesale and retail sales.

Dayton is within 60% of the population and manufacturing capacity of the U.S. and so is defined as one of only two major logistics centroids in the United States. It plays host to significant industrial, defense and aerospace, technological/engineering research activity, and is known for its many technical innovations and inventions. Dayton's businesses have diversified into a service economy, including the insurance and legal sectors and most importantly the healthcare and government sectors. Wright-Patterson Air Force Base and hospitals in the Greater Dayton area account for much of the Dayton area's economy.
